nl50 passive approach is bad here?

villain is 1 tabling fish
Preflop ($0.75) Hero is UTG with 9 T
Hero raises to $1.50, 2 folds, BN calls $1.50, 2 folds
Flop ($3.75) 9 6 8
Hero checks, BN bets $1.50, Hero calls $1.50
vs regs I autocheck this board, but vs fishy guy I hate it. They are passive enough to check behind all KJ+ no pair type of hand. Against them we need protection. On a second thought, not bad to check-raise as played? (and try to showdown unimproved)
